The purchaser recognises and agrees that:

The Squiggy E-Bike arrives in a box and come 95% assembled. Self assemble is required on the front wheel, handle bar and pedals. For local pick up, assembly is done free of charge.

A thumb throttle is available and you can de-limit the motor for greater speeds for use only on private property only. Limited by Australia Law for on road use to 25km/ph. 40km/ph plus in unlimited mode for private property use only.

Use of the Squiggy ebike is undertaken at the purchaser’s sole risk. The purchaser agrees that cycling and electric bicycle riding, and related activities involve inherent and obvious risks, which may result in serious damage or death. These risks and dangers may be caused by the purchaser’s own actions or inactions, the actions or inactions of others participating in activities or the conditions in which the activities take place.

E-bike riding and related activities may be determined to be dangerous recreational activities for the purpose of the Civil Liability Acts in the various states and territories of Australia. In accordance with that legislation the purchaser assumes all risk in relation to use or participation of that activity. Further, Squiggy is not liable in negligence or contract for harm suffered by the purchaser or another person as a result of the materialisation of an obvious risk of a dangerous recreational activity engaged in by the person suffering harm. This applies whether or not the person suffering harm was aware of the risk.

There may be other risks and social and economic losses either known or unknown to the purchaser or not readily foreseeable at the time of purchase or at the time the Squiggy e-bike is used. The purchaser agrees the Squiggy is not liable for any losses suffered by the purchaser or other user of the Squiggy e-bike for any loss arising from the assumption of such risks.

The Purchaser hereby releases, discharges and agrees to accept and assume all responsibility and risk in relation to use of the Squiggy e-bike. This includes accepting liability for injury, death, illness, disease, or damage to other third parties and their property arising from use of the Squiggy ebike by the purchaser or their agents. The Purchaser’s participation in any activity or use of the Squiggy ebike is purely voluntary and the purchase of the e-bike is undertaken on the basis that the purchaser expressly agrees to participate in activities or to use the Squiggy ebike despite the risks. To the extent permitted by law, Squiggy has no liability in relation to the purchaser’s use of a Squiggy ebike.

In no circumstances should the Squiggy ebike be delimited for on road use or modified in any other way. It is acknowledged and agreed that any modification or delimitation could result in the requirement for the purchaser or user to comply with additional traffic and vehicle laws in various states or territories. Squiggy is not responsible for any breach of those laws by the purchaser in any circumstances, and the purchaser indemnifies Squiggy in relation to any claim or fine made against or imposed on Squiggy by the purchaser, an agent of the purchaser or any third party arising from the purchaser’s breach of any law or their modifications to the Squiggy ebike.

Under no circumstances shall Squiggy be liable for any direct, indirect, incidental, special or consequential damages that result from the use or misuse of, or the inability to use, the Squiggy e-bike, any Squiggy products or services, third party materials, products, or any services made available through any Squiggy website or service provider. Indirect loss includes, but is not limited to, loss of wages or income, medical costs, loss of opportunity, third part costs, loss of profit, reputational damage.

You agree to indemnify, defend and hold harmless Squiggy from and against any and all third party claims, demand, liabilities, costs or expenses, including reasonable solicitors' fees arising from the use or misuse of, or the inability to use, the Squiggy e-bike, any Squiggy products or services, third party materials, products, or any services made available through any Squiggy website or service provider or related to any breach, or any claim made arising out of or in relation to the purchaser and use of the Squiggy e-Bike.

The purchaser agrees that these terms of purchase amount to a risk warning for the purpose of the Civil Liability Act 2002 (NSW) and related legislation in other States and Territories. The purchaser further agrees that Squiggy makes no representations or warranties (express or implied) that any services will be provided with due care and skill and all liability in relation to any such services is hereby excluded.
